What is a Stormwater Maintenance Agreement?
Legally binding document between an Owner and an MS4 outlining the responsibilities for maintaining stormwater management facilities on a property.
What does the agreement entail?
- Assign responsibility for the maintenance and repair of the stormwater facility to the Owner of the property
- Provide for a periodic inspection by the property Owner for the purpose of documenting maintenance and repair needs and ensuring compliance with respective ordinance (annual)
- Provide minimum maintenance and repair needs including, but not limited to:
- Removal of silt, litter and other debris
- Cutting of grass and vegetation removal
- Leave in replacement of landscape vegetation in basins, inlets, drainage pipes and other stormwater facilities
- Provide the property Owner shall be responsible for additional maintenance and repair needs
- Provide that maintenance needs must be addressed in a timely manner
- Provide if the property is not maintained or repaired within the prescribed schedule, the MS4 shall perform the maintenance and repair at its expense and bill the cost thereof to the property Owner
- Provide the property Owner allow MS4 inspectors on the property to conduct Municipal stormwater inspections (Every 5 years or as needed)
Permitting Process (New Development)
If the proposed project has stormwater features requiring a SWMA, the Certificate of Occupancy will not be issued until the agreement is completed, signed, and recorded at the SLCO Recorder's office along with a Stormwater Management Plan.
Discussion of the requirements will be addressed during the Grading Review phase by the Grading Reviewer.
